DeepSeek Harness products and services are owned and operated by Hangzhou DeepSeek Artificial Intelligence Co., Ltd. (hereinafter referred to as "we" or "DeepSeek"). Before using the Services, please be sure to carefully read and understand these DeepSeek Harness Terms of Use (hereinafter referred to as these "Terms") as well as other relevant agreements, policies, or guidelines of this platform. When you use a specific feature of the Services, there may be a separate agreement, relevant business rules, and the like for that specific feature (hereinafter referred to as a "Specific Agreement"). If the content of these Terms conflicts with that of a Specific Agreement, the provisions of the Specific Agreement shall prevail. All of the foregoing terms and rules constitute an inseparable part of these Terms (collectively, the "Entire Agreement") and have the same legal effect as the body of these Terms.

For the specific rules on how we collect, protect, and use personal information, please carefully read the DeepSeek Harness Privacy Policy.

We especially remind you to carefully read (minors under the age of 18 or the minimum age required in your country shall read with their legal guardian) and fully understand all the terms before using the Services. When you agree to these Terms through online page clicks, or checking boxes, it means you and we have reached an agreement on All Terms, you have accepted All Terms and their applicable conditions, and agree to be bound by All Terms. If you disagree with any part of these Terms, or cannot accurately understand our interpretation of any term, please click disagree or stop using our services.

I. General Terms

1. Services

(1) Our products and services include the products and services we provide to you through web pages, applications (which may include different versions), mini programs, software development kits (SDKs) for use by third-party websites and applications, application programming interfaces (APIs), and innovative forms that emerge with technological development, including but not limited to a platform whose core function is calling AI models and tools (hereinafter referred to as "DeepSeek Harness" or the "Services").

(2) DeepSeek Harness provides services in the following two modes:

  • Official models: When you use the DeepSeek official models configured by default after registering and logging in, we provide you with a full-chain service from the foundation model to the interaction medium. To learn about the filing status and basic principles of the DeepSeek model and algorithm, please see the Model Principles and Training Methods Disclosure.
  • Custom models: You may also configure an AI model API that you have obtained yourself to use our Services. In that case, we only provide the interaction medium for model calls, including the locally run interactive interface, supporting tools, and communication technologies, while the model service is provided by the model service provider you call.

(3) With the continuous iterative development of generative artificial intelligence technologies, models, and products, as well as changes in laws and regulations, we may add, upgrade, change, suspend, or terminate the Services, or make necessary adjustments to the technology, methods, performance, and the like of the Services, and may conduct internal or external testing for newly added service features.

(4) We will take necessary measures no less rigorous than industry practice to ensure the cybersecurity and stable operation of the platform, and will strive to enhance and improve our technology to ensure your product and service experience. If you have any questions or feedback about our Services, you may contact us in the manner set out in Section VII.

2. Security Policy

(1) Harness and related technologies such as agents are still at an early stage of development and are innovative and experimental in nature. The DeepSeek Harness Services are also still in a continuous testing phase and must not be regarded as fully secure or ready for production environments.

(2) All outputs and work products provided by the Services are completed automatically through AI-driven automation. When using the Services, you should note the following security issues and limitations that the Services may give rise to:

  • The Services may contain errors or omissions and are provided for your reference only; you should not treat the output as professional advice. In particular, when you use the Services to consult on medical, legal, financial, and other professional matters, please note that the Services do not constitute any advice or commitment and do not represent the opinions of any professional field. If you need relevant professional services, you should consult professionals and make decisions under their guidance. The output of this software should not be the basis for your further action or inaction. Any judgment you make based on the output, or any subsequent related actions you take based on it, and the consequences and liabilities arising therefrom shall be borne by you alone, including risks arising from reliance on the truthfulness, accuracy, reliability, non-infringement, or fitness for a particular purpose of the output. You should understand generative artificial intelligence technology in a scientific and rational manner and use it in accordance with law.
  • The Services can access a variety of systems and can execute model-generated code and commands on behalf of the user, load third-party plugins, and access networks, processes, credentials, and files made available to them. Although most foundation models include basic defenses against prompt injection, inherent risks remain when using DeepSeek Harness to interact with the internet or to operate through other untrusted data sources. Erroneous model output, defects, misconfiguration, malicious input, or untrusted plugins may damage the host computer, modify or delete files, leak data or credentials, or cause other unintended effects.
  • You acknowledge and confirm that we only provide AI-assisted operation technical services, and that the operational actions carried out based on your instructions are all extensions of your own actions. The records and results arising therefrom, including order transactions, chat communications, email sending, file creation/deletion/modification/movement/sending/uploading/making public, file reading, code execution, Git operations, package managers, network requests, third-party account operations, product usage, etc., all constitute your own actions, are controlled by you, and you shall bear the corresponding responsibility.

(3) Sandboxes, approval prompts, and permission controls can reduce risk, but they do not guarantee isolation and cannot guarantee that harm will be prevented. Even where restrictions are correctly enforced, they cannot protect resources that the project has been permitted to access.

(4) To minimize these risks as much as possible, you should use the Services responsibly and are advised to take the following precautions:

  • Grant this project only the minimum permissions and scope of access required.
  • Prefer running in a disposable virtual machine, container, or dedicated environment.
  • Back up the files this project can access.
  • Do not expose sensitive credentials or data to it unless you accept the associated risks.
  • For any system and operation that may cause significant changes, always require human confirmation, and review the plugins, configuration, and commands to be executed before allowing them to run.
  • Always carefully review code and test content generated by the Agent to ensure its accuracy.
  • Where possible, split complex Agent instructions into smaller, mutually isolated operations. This helps reduce the risk of a single erroneous command affecting multiple parts of the system at once and makes anomalous behavior easier to detect.
  • Install and run only plugins, MCP servers, Skills, Hooks, and their dependencies that come from trusted sources and have been reviewed.
  • In some cases, the Agent may execute commands embedded in content even where those commands conflict with the task assigned to the Agent. We recommend taking the precautions above to limit the risks posed by prompt injection.

By taking these steps, you can reduce the potential security risks associated with Agents and better protect your system and users. If you discover a security vulnerability, we recommend that you report it privately through the repository at harness-privacy@deepseek.com.

3. Requirements and Restrictions

(1) You fully understand and agree that, under these Terms, we grant you a revocable, non-transferable, and non-exclusive right to legally use this product and related services. All other rights not expressly authorized by these Terms are reserved by DeepSeek, and before exercising such rights, you must obtain written permission from DeepSeek. Additionally, DeepSeek's failure to exercise any of these rights does not constitute a waiver of those rights. If you publish or disseminate outputs generated by the Services, you must: (1) proactively verify the authenticity and accuracy of the output content to avoid spreading false information; (2) clearly indicate that the output content is generated by artificial intelligence, to alert the public to the synthetic nature of the content; (3) avoid publishing and disseminating any output content that violates the usage specifications of these Terms.

(2) When using the Services provided by DeepSeek, users shall comply with these Terms and adhere to the principles of voluntariness, equality, fairness, and good faith. Users shall not use the Service to engage in, facilitate, or promote any activities violating laws or regulations, infringing on the legal rights or interests of others or seek unjust benefits, nor shall you disrupt the normal order of the internet platform.

(3) When using the Services, you may obtain and configure third-party plugins, MCP servers, Skills, Hooks, and their dependencies on your own. These tools and services are provided by third parties, and we are not responsible for third-party tools or services. Please use and install them prudently, take care to review their agreements or documents, and protect the security of your information and property.

4. Intellectual Property and Other Rights

(1) DeepSeek is the developer and operator of this service and holds all rights within the scope permitted by laws and regulations in this service (including but not limited to software, technology, programs, code, model weights and parameters, user interfaces, web pages, text, graphics, layout designs, trademarks, electronic documents, etc.), including but not limited to copyrights, trademark rights, patent rights, and other intellectual property rights. However, this excludes rights that relevant rights holders are entitled to under legal provisions or the terms of this agreement (such as Inputs and Outputs,and authorizations under open-source licenses).

(2) Without our permission, you or your end users shall not use any trademarks, service marks, trade names, domain names, website names, company logos (LOGOs), URLs, or other prominent brand features related to the Services, including but not limited to "DeepSeek","DeepSee Harness" etc., in any way, either singly or in combination. You are not allowed to display, use, or apply for registration of trademarks, domain names, etc., related to the aforementioned terms in any way, and you shall not perform acts that expressly or implicitly indicate the right to display, use, or otherwise deal with these identifiers to others except as permitted by the relevant law and licensed by DeepSeek.

II. Official Model Services

1. Account

(1) When you use our default model services, we provide you with generative artificial intelligence services, and you need to register and log in to a DeepSeek account before using our default model services.

(2) As part of the DeepSeek series of services, the Services use a unified DeepSeek account. You shall register, log in to, and use the account in accordance with the requirements of the DeepSeek Terms of Use, and shall comply with laws and regulations and the requirements regarding account management in the DeepSeek Terms of Use.

(3) When using the default model services, you need to make a prepayment to your account on the DeepSeek Open Platform in advance. The account recharge methods, billing prices, consumption methods, and management requirements are all agreed in the DeepSeek Open Platform services, and you shall comply with the relevant requirements of the DeepSeek Open Platform Terms of Service.

2. Requirements and Restrictions

(1) To fulfill legal and compliance requirements, DeepSeek has the right to use technical means to review the behavior of users using the Services, including but not limited to establishing risk filtering mechanisms, and creating databases for illegal content features.

(2) You will not use the Services to generate, express or promote content that:

  • is hateful, defamatory, offensive, abusive, tortious or vulgar;
  • is deliberately designed to provoke or antagonize another or is bullying or trolling another;
  • may harass, intimidate, threaten, harm, hurt, scare, distress, embarrass or upset another;
  • is discriminatory such as discriminating another based on race, gender, sexuality, religion, nationality, disability or age;
  • is pornographic, obscene, or sexually explicit (e.g., sexual chatbots);
  • facilitates, promotes, incites or glorifies violence or terrorist/extremism content;
  • exploits, harms, or attempts to exploit or harm minors or exposes minors to such content;
  • are designed to specifically appeal to or present a persona of any person under the age of 18 or the minimum age required in your country; or
  • constitute, encourage or provide instructions for a criminal offence;

(3) You will not use the Services for the following improper purposes:

  • Using the Services for any illegal purpose that violates laws and regulations, regulatory policies, or infringes upon the lawful rights and interests of third parties.
  • Using the Services for any activity that illegally intrudes into, damages, or interferes with computer information systems, or steals computer information system data.
  • Using the Services for dangerous purposes that may have seriously harmful effects on personal health, psychology, society, or the economy, or that violate science and technology ethics.
  • Engaging in conduct that infringes upon intellectual property rights, trade secrets, and other conduct that violates business ethics, or using advantages in algorithms, data, platforms, and the like to engage in monopolistic and unfair competitive conduct.
  • Copying, transferring, leasing, lending, selling, or providing sublicenses or sub-permissions for all or part of the Services without DeepSeek's authorization.
  • Using the Services to engage in or assist high-risk activities, such as military and warfare, the development of weapons, explosives, or hazardous materials, the management or operation of critical infrastructure (such as transportation and energy), the creation or distribution of controlled substances or services, the generation or dissemination of information related to self-harm, and activities with a high risk of economic harm, including gambling, automated determination of credit eligibility, and employment and education decisions.
  • Other methods of use prohibited or restricted by laws and administrative regulations, or that may harm the interests of DeepSeek.

3. Input and Output

(1)You are responsible for all Inputs you submit to our Services and corresponding Outputs. By submitting Inputs to our Services, you represent and warrant that you have all rights, licenses, and permissions that are necessary for us to process the Inputs under our Terms. You also represent and warrant that your submitting Inputs to us and corresponding Outputs will not violate our Terms, or any laws or regulations applicable to those Inputs and Outputs.

(2)Subject to applicable law and our Terms, you have the following rights regarding the Inputs and Outputs of the Services: (1) You retain any rights, title, and interests—if any—in the Inputs you submit; (2) We assign any rights, title, and interests—if any—in the Outputs of the Services to you. Due to the nature of our Services and artificial intelligence generally, Outputs may not be unique and other users may receive similar Outputs from our Services. Our assignment above does not extend to other users’ Outputs. (3) You may apply the Inputs and Outputs of the Services to a wide range of use cases, including personal use, academic research, derivative product development, training other models (such as model distillation), etc., as long as such usage is legal and adhere to these Terms.

(3)Under the premise of secure encryption technology processing, strict de-identification rendering, and irreversibility to identify specific individuals, we may, to a minimal extent, use Inputs and Outputs to provide, maintain, operate, develop or improve the Services or the underlying technologies supporting the Services. If you refuse to allow us to process the data in the manner described above, you can opt out by contacting us through the contact information in Article VIII.

(4)The Output may include information from third-party websites or other external sources. We are not responsible for the validity of such content, nor do we guarantee the authenticity, legality, or security of any content, products, services, or other materials obtained through these channels. We may provide links to third-party websites in the Outputs for informational purposes only and disclaim all liability for their content, services, or practices. Your use of any such link is undertaken at your sole discretion and risk. You acknowledge and agree that it is your responsibility to evaluate the third party's terms, protect your data, and secure your property when engaging with these external resources.

III. Custom Model Services

1.You may use the custom model services without registering or logging in to an account. When using such services, you need to obtain and configure the model API yourself. DeepSeek Harness only provides the interaction medium for model calls, including the locally run interactive interface, supporting tools, and communication technologies.

2.When you use the custom model services, DeepSeek Harness is a purely neutral calling tool. As the party configuring and using the model, you shall bear the legal responsibility for using artificial intelligence services. You understand and agree that:

  • You warrant that the custom models you configure are purchased or licensed through lawful channels, and you may not connect to model services of unknown origin, illegal, or infringing model services.
  • You shall bear all costs arising from calling custom models (such as token consumption costs and subscription plan fees). Because Input may continuously call custom models, we recommend that you closely monitor the account charges of the custom model to avoid incurring costs beyond your expectations.
  • When configuring and using custom models, you shall comply with the rules and requirements of the corresponding large model service provider. Any dispute or loss arising from the custom model services shall be resolved by you and that large model service provider on your own.

3.Your Input will be sent directly to the corresponding AI model for processing, and the Output will also be returned directly by that AI model. DeepSeek Harness does not store or process your Input and Output on the server side. The rights you enjoy in the Input and Output and the responsibilities you should bear shall be agreed between you and the large model service provider or handled in accordance with legal provisions.

4.We cannot control or guarantee the accuracy of content, service quality, or data privacy and security of any models you connect to on your own, and we assume no liability for their actions. If you use a third-party large model, please carefully read the relevant legal agreements of that model service provider, such as the user agreement and privacy policy. You shall be solely responsible for your use of any third-party model.

IV. Complaints and Feedback

If you believe that our service infringes on your intellectual property rights or other rights, or if you find any illegal, false information or behaviors that violate these Terms, or if you have any comments and suggestions about our services, you can submit them by going to the product interface, checking the avatar, and clicking the "Contact Us" button, or by providing truthful feedback to us through our publicly listed contact email as provided in Section VIII. We take your opinions seriously and will take legal actions accordingly. We appreciate your feedback, and you agree that we may use it without restriction or compensation to you.

V. Disclaimer of Warranties, Limitations of Liability, and Indemnity

1.NOTHING IN THESE TERMS SHALL AFFECT ANY STATUTORY RIGHTS THAT YOU CANNOT CONTRACTUALLY AGREE TO ALTER OR WAIVE AND ARE LEGALLY ALWAYS ENTITLED TO AS A CONSUMER.

2.In response to your violation of these Terms or other service terms, or your use of our Services could cause risk or harm to DeepSeek, our users, or anyone else, DeepSeek reserves the right to independently judge and take measures against you, including but not limited to, issuing warnings, setting deadlines for correction, restricting account functions, suspending usage, closing accounts, prohibiting re-registration, deleting relevant content, etc.. For behaviors suspected of violating laws and regulations or involving illegal activities, relevant records will be retained, and reports will be made to the competent authorities in accordance with the law, cooperating with their investigations. You shall be responsible for any legal liabilities, claims, demands, or losses asserted by third parties resulting therefrom, and you shall compensate us for any losses incurred, including but not limited to litigation fees, arbitration fees, attorney fees, notary fees, announcement fees, appraisal fees, travel expenses, investigation and evidence collection fees, compensation, liquidated damages, settlement costs, and administrative fines incurred in protecting our rights. However, if we are also at fault, liability shall be apportioned between you and Deepseek based on the degree of fault, as determined under applicable laws and regulations.

3.THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS AND WE MAKE NO WARRANTY, REPRESENTATION OR CONDITION TO YOU WITH RESPECT TO THEM, WHETHER EXPRESSED OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED TERMS AS TO SATISFACTORY QUALITY, FITNESS FOR PURPOSE OR CONFORMANCE WITH DESCRIPTION. IN PARTICULAR, WE DO NOT REPRESENT OR WARRANT TO YOU:

(1) THAT YOUR USE OF THE SERVICES WILL MEET YOUR REQUIREMENTS;

(2) THAT YOUR USE OF THE SERVICES OR ANY PART THEREOF WILL BE UNINTERRUPTED, TIMELY, SECURE OR FREE FROM ERROR;

(3) THAT ANY OUTPUT OR OTHER INFORMATION OBTAINED BY YOU AS A RESULT OF YOUR USE OF THE SERVICES WILL BE ACCURATE, UP-TO-DATE, RELIABLE, NON-INFRINGING OR SECURE;

(4) THAT DEFECTS IN THE OPERATION OR FUNCTIONALITY OF THE SERVICES WILL BE CORRECTED;OR

(5) WITH RESPECT TO THIRD PARTY OFFERINGS.

4.Unless otherwise agreed, either DeepSeek or you shall not be liable for the other’s incidental, consequential, punitive, special, or indirect losses or damages, including but not limited to the loss of profits or goodwill, unless such losses or damages result from its own intentional or gross negligent conduct. This limitation applies irrespective of any litigation brought under breach, tort, compensation, or any other legal grounds, even if the party was informed of the possibility of such losses. OUR AGGREGATE LIABILITY UNDER THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE THAT GAVE RISE TO THE CLAIM DURING THE 12 MONTHS BEFORE THE LIABILITY AROSE. THE LIMITATIONS IN THIS SECTION APPLY ONLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

5.You agree to indemnify, defend, and hold us, our affiliates, employees and licensors (if any) harmless against any liabilities, damages, and costs (including reasonable attorneys' fees) payable to a third party arising out of a breach by you or any user of your account of these Terms, your violation of all applicable laws and regulations or third party rights, your fraud or other illegal acts, or your intentional misconduct or gross negligence, to the extent permitted by the applicable law.

6.DeepSeek’s affiliates, suppliers, licensors, and employees are intended third party beneficiaries of this section.

VI.Export Control and Sanctions

You understand that your use of Services, providing Inputs to and obtaining Outputs via Services, might be subject to all applicable laws and regulations of export controls and sanctions laws (collectively "Export Control and Sanctions Laws") . You recognize that you are solely responsible for complying with all applicable Export Control and Sanctions Laws related to the access and use of the Services of you and your end user. You represent and warrant that Services may not be used in or for the benefit of, or exported, re-exported, or transferred (a) to or within any country subject to comprehensive sanctions under Export Control and Sanctions Laws; (b) to any party on any restricted party lists under any applicable Export Control and Sanctions Laws that would prohibit your use of Services. Our Services shall not be used for any end use prohibited by applicable Export Control and Sanctions Laws, and your and your end user's Inputs shall not include material or information that requires a license for release or export.

VII. Governing Law and Jurisdiction

1.The establishment, execution, interpretation, and resolution of disputes under these Terms shall be governed by the laws of the People's Republic of China in the mainland.

2.In the event of a dispute arising from the signing, performance, or interpretation of these Terms, the parties can make efforts to resolve it amicably through negotiation. Also either party has the right to file a lawsuit with a court having jurisdiction over the location of the registered office of DeepSeek.

VIII. Miscellaneous

1.In order to provide you with better services or to comply with changes in national laws, regulations, policy adjustments, technical conditions, product functionalities, and other requirements, we may revise these Terms from time to time. The revised content will form an integral part of these Terms. Once announced, it replaces the original terms. Please refer to the latest version of these Terms on the official website. If you do not accept the modified terms, please stop using the Service immediately. Your continued usage of the Service will be considered as your acceptance of the modified terms.
